Zusammenfassung: | Abstract This work analyses the exclusion of the mandatum morte dissolvitur principle in Roman law and in the Spanish legal tradition until the 1889 Civil Code. On one hand, we found exceptions to the enforceability of this principle in the institute of the mandatum post mortem which, in spite of being discussed in classic law, attained some degree of recognition in Justinian law, and subsequently vanishes as from the doctrine of jurisprudential reception; and on the other, in other fully accepted hypotheses by the legal reception and the current Spanish law, in which the mandate agreement remains after the death of the principal or agent.
