Zusammenfassung:The Supreme Court of New South Wales Chief Justice Francis Forbes in the year 1834 gave a judgement on colonial contracts and expectation damages in the case of Girard v Biddulph. In his judgement he stated that 'it is the duty of the Court to apply the principles to it in common with all other cases of contract and to see that the damages which may be assessed by the Jury are founded on proper allegation and proof'. Here his aim was to lay down the general principles under which damages are to be assessed for breach of contract.
