Zusammenfassung:Article 41 of the Spanish constitution contains the key to the new Spanish social security system; it therefore amounts to its constitutional foundation. This provision lays down a governing principle for welfare policy. In view of Article 41, it is possible to differentiate between 2 general areas within the Spanish Social Security system: a public and a complementary system. As in many other countries, many people in Spain have been questioning the future viability of the public pension system. The main factors that influence the public welfare system crisis are discussed.
