This year's Survey highlights a number of loss allocation rules cases. The bulk of these cases involves the fictitious payee and "padded payroll" preclusion rule. There are also some fund transfer cases that demonstrate that the exclusivity principle of Article 4A is not easy to implement and needs clarification. |
