Lochner Abroad: Substantive Due Process and Equal Protection in the Federal Republic of Germany
The case of "Lochner vs New York" demonstrated the Supreme Court's belief that it should be the ultimate censor of the reasonableness of all governmental action. Germany, with its similar constitutional traditions, wrestled with the same issue. The German experience is discussed.
