Zusammenfassung:In a number of recent cases the Court of Justice refined its policy towards national organization of the lottery and gambling market, which is, as is demonstrated by the number of written observations submitted on behalf of governments, a sensitive policy area. The Court did not change its previous approach, which is basically founded on a substantially relaxed principle of proportionality, but adjusts it, mainly because it was given the opportunity to do so for the first time in Gambelli, a case in which the Italian Government carried the latitude granted by the Court to the extreme.
