| Zusammenfassung: | The current paper deals with the debate over the interpretation of the Italian union as it was illustrated by professor Paolo Biscaretti di Ruffia in 1961, on the occasion of the 100th anniversary of the unification of Italy. In particular, his article may be considered a significant compendium of the different positions within the Italian legal scholarship about the unification process. Subsequently, with a few rare exceptions (Costantino Mortati), this subject has been of little interest to the same scholarship leaving a question in a state of uncertainty: foundation of a new State or continuity with the Piedmont Kingdom, although the second thesis prevails.
