Zusammenfassung: | Every plug must find its proper place, and every case in point its appropriate normative clarification; and if it fails to do so, this can only produce a troubling lacuna with respect to the realisation of the ethico-political juridical and constitutional principles, if it is considered from the meta-theoretical perspective of the whole coherent structure. With full awareness of the disparity between logical principles and actual law (including his principia iuris), Ferrajoli accords the normative burden to the sphere of logic in relation to the positive law of the constitutional state: the gap produced by the lack of correspondence between logic and the positive reality of law is filled by the authoritatively normative and prescriptive character of logical and meta-juridical discourses in relation to the positive ones. |
