In 2011, the Securities and Exchange Commission launched an investigation looking into George Jarkesy's investment activities with his two hedge funds. The second is whether statutory provisions that authorize the SEC to enforce the security laws through an agency adjudication, instead of filing a district court action, violate the non-delegation doctrine. The third is whether Congress violated Article II by granting for-cause removal, protection to the administrative law judges within federal agencies whose leaders enjoy for-cause removal protection. |
