Zusammenfassung:[...]States now regularly resort to sanctions, countermeasures, and peacetime influence operations to vindicate their positions, interests, and values.5 At the same time, States have achieved consensus on the idea that international law directs States along an alternative path towards reconciliation whenever their conflicts or tensions come to constitute a dispute: peaceful settlement. "6 Article 33 suggests a list of modalities (e.g., negotiation, mediation, arbitration) for addressing disputes that, if left unresolved, would endanger international peace and security.7 Other Charter provisions elaborate peaceful dispute settlement roles for regional organizations, the UN Security Council, and the International Court of Justice (ICJ).S States, moreover, regularly acknowledge the place of peaceful settlement of disputes within international law. [...]as a practical matter, we believe it is necessary to look beyond compliance questions to assess whether and when peaceful settlement will be effective. Peaceful settlement's historical legacy creates a bridge to bring together States otherwise stalemated over anything from nuclear submarines to data protection.
