According to the statute, upon receiving a legitimate complaint, the agency "shall endeavor to eliminate any such alleged unlawful employment practice by informal methods of conference, conciliation, and persuasion. According to Title VII, in the event of disparate impact litigation, a three-pronged analysis will be applied to evaluate the lawfulness of an employment procedure.22 Notably, each of these prongs has been subject to varied interpretations since the U.S. Supreme Court's first application of Title VII in Griggs; the details of these changes over time will be discussed later in this paper. |
