Zusammenfassung:The emotional discussion about the introduction of Paragraph 28a in the IfSG has made it clear how great the need for a parliamentary debate on the Corona protective measures is across factions. In particular, the opposition factions see themselves being passed over by the government. Their main argument is that the federal government, together with the state governments, is adopting specific protective measures and thus interfering with fundamental rights without parliaments being sufficiently involved. This “ruling through from above” diminishes the legitimacy of the measures adopted and damages democracy in the long term. The right to decide on all essential issues must remain with the parliaments alone.
