Notiunile de „functionar public", „salariat" si „personal contractual" în viziunea Codului administrativ si din perspectiva corelatiei cu alte acte normative

The present study aims to analyze the meaning of the notions of „civil servant", „employee" and „contractual staff" in the vision of the Administrative Code. This normative act enshrined for the first time, in the legislative history of Romania, legal rules applicable to all categories of staff working in the public administration. Such a situation reveals a recognition by the legislator of the fact that, beyond the different legal situations, the act on the basis of which they carry out their activity, the way in which all those who carry out their activity in the administration have been appointed, employed, recruited have in common certain requirements to which they must be subject, a certain purpose which they must satisfy, certain correlative rights and obligations, which particularize their activity and legal situation. In this content, we determine correlations between the concepts presented above, the significance of each of them and how it influences the future of public and private labor law.
