Zusammenfassung:Sections 287 and 1001 of Title 18 of the US Code make it a crime to knowingly make a false claim upon or against the US or to any department or agency thereof and to knowingly and willfully make a false statement to the US or to any department or agency thereof, respectively. It doesn't constitute a violation of the Double Jeopardy Clause to punish defendants under both § 287 and § 1001 because the language of the statutes demonstrates Congress intended to create two distinct violations. Here, Halverson and Olson discuss prosecutions brought under § 1001, the False Statements Act, and address criminal charges brought under § 287, the False Claims Act. They also examine the civil false claims statutes §§ 3729-30.
