Zusammenfassung: | Grundfest and Pritchard believe that the "strong inference" provision of the Private Securities Litigation Reform Act of 1995 (PSLRA) satisfies the requirements necessary for a formal statistical analysis. In an attempt to discourage meritless securities fraud litigation, the PSLRA requires that private plaintiffs, in addition to satisfying the specificity requirements of Federal Rule of Civil Procedure 9(b), "state with particularity facts giving rise to a strong inference that the defendant acted with the requisite state of mind." |
