Zusammenfassung: | Although the reporting period (November 2018-January 2019) is relatively short, the Court of Justice of the European Union did deliver several rulings that are significant for social security. The ruling that stands out in Balandin, which addressed the question of whether third-country nationals who habitually reside outside the EU but temporarily work in one or more Member States can benefit from the coordination rules contained in Regulation 883/2004. In addition, the Court offered clarification on the application of the notion of 'restriction' of freedom of movement in the field of social security law (Zyla), the application of the prohibition of discrimination on grounds of sexual orientation to retirement pensions (E.B.) and the social protection of refugees (Ayubi). |
