The special role that a defense economist can play in pretrial negotiations is examined. The defense attorney does not negotiate with full information without an economist's review to determine the magnitude of the loss. The valuable information provided by the economist not only can change each side's bargaining strategy; it can also facilitate a settlement that will avoid a trial. |
