Zusammenfassung: | An entertainment license to operate a discotheque and a special use exception allowing for a restaurant are superseded by a zoning ordinance restricting discotheques because a particular use of land may be permitted only by: (1) the adoption of a zoning ordinance; or (2) by a board of adjustment's grant of a use variance. The first step requires a planning board to adopt a land use master plan to be approved by a majority vote of the governing body. second, once a master plan has been approved, a governing body may adopt zoning ordinances which regulate land use but only if the planning board agrees that the regulations are consistent with the master plan. |
