Zusammenfassung:In Daubert v. Merrell Dow Pharmaceuticals, Inc. (1993), the Supreme Court concluded that the Federal Rules of Evidence dispense with the "general acceptance" standard that previously dominated the field. This paper proposes at least partial solutions to the boundary and usurpation problems, and it applies them to statistical and econometric proof. In addition, it reviews the developments that have culminated in the modern use of sophisticated statistical equations and models to prove factual claims.
