Zusammenfassung:After the II World War II it was clearly revealed the necessity to create a criminal regulation of armed conflicts, trying not to leave unpunished those responsible for the atrocities committed during war periods. Thus, the Geneva Conventions, the two Additional Protocols, and the jurisprudence of the International Courts, shown the necessity of an International Criminal Court, which was established by the Rome Statute in 1998, creating the called International Criminal Law. Victims of armed conflicts, in particular, women deprived of their liberty, have a compendium of rights and penal prosecutions and guarantees, which need to be respected in order to grant their full criminal protection. So, in this article, we briefly explain the criminal protection that victims of armed conflicts have during a criminal prosecution, going through all legal instruments, taking into account the International Humanitarian Law and Human Rights provisions and the International Criminal case-law.
