DISCUTII PRIVIND TITULARII DREPTULUI LA ACTIUNEA ÎN TAGADA PATERNITATII ÎN REGLEMENTAREA ACTUALULUI COD CIVIL/DISCUSSION CONCERNING THE HOLDERS OF THE ACTION OF DENYING PATERNITY IN THE REGULATION THE CURRENT CIVIL CODE

Gavrilescu analyzes the current Romanian Civil Code provisions governing the rights of the holders of denying paternity action, namely: the husband of the mother, the mother of the child, the biological father of the child, their heirs and the guardian. According to art. 429 of the Civil Code, denying paternity proceedings can be initiated by the husband of the mother, the mother, the biological father of a child, but also by their heirs. The action started by the husband of the mother, the mother, the biological father of the child can be continued by heirs if the right holder dies during trial action.
