Zusammenfassung: | A trustee cannot, it has been held, resist on the grounds of legal professional privilege disclosure to a beneficiary of legal advice taken for the purpose of administration of the trust and paid for from the trust fund. How this principle is reconciled with privilege being a fundamental human right is unexplained by the authorities. Since confidentiality is necessary to claim privilege, it is proposed that a trustee's duty to account to beneficiaries generally, but not always, negates confidentiality and thus privilege; but if the trustee had a reasonable expectation of confidentiality, it should be able to claim privilege. |
