Matrimonial property: the proposed EU regulation

The European Commission published a proposed Regulation on Matrimonial Property Regimes. Under this Proposal there will be uniform jurisdictional and choice of law rules throughout the European Union for married couples and any judgment obtained in a Member State will be entitled to automatic recognition and enforcement throughout the European Union. This article will outline the main provisions of the Proposal and explore whether it would be in the UK's best interest for it to opt-in.
