Direito à saúde: considerações a respeito do fornecimento de medicamentos pela via judicial

The right to health, constitutionally guaranteed, includes the access to necessary medicines for the achievement of treatment. The dispensing of such medicines is responsibility of the Government that, divides responsibility among members of the Federation, draws up lists of drugs which can be distributed to the population. The issue is in relation to the medicines that are not on such lists, and, therefore, are not provided. So that to ensure an effective health policy, its necessary that occurs such a supply, even though for it the citizen has to use the judicial via, having the Judiciary to enforce the right to health, constitutionally guaranteed.
