The work has the intention to take a look at environmental insurance in Cuban law; therefore the authors make a brief historical analysis of the insurance business in the country until the revolutionary triumph. They rely the execution of this analysis related to the institution of the insurance contract, and in particular, the mandatory environmental insurance regulations in countries like Spain, Argentina, and Chile as part of comparative review under the law. The authors accomplished an analysis of the environmental policy in Cuba, departing from the constitutional text, the related mercantile activity related to the insurance policy and foreign investor, with an analysis of legal regulations that have contextualized the insurance in Cuban law. They rely to run the article using scientific methods to support the historical logical research, exegetical and legal analysis and review of both social scientific and legal documents.
