This paper reviews the book "Utopía y Poder Constituyente" written by Prof. Albert Noguera. Among the evolution of "democratic State" into "neoliberal State", instruments used by the people to increase their rights have been cancelled by a new State's model. This new State's model does not offer any possibility of progress. This impossibility forces a necessary rupture and implies the need of new theoretical ways of implement a constituent power that overcome the power and hegemonic culture that we are living nowadays.
