Zusammenfassung: | China’s antitrust law(Anti-Monopoly Law) is known as the Constitution of the Chinese economy. This law contains the monopoly agreement, abuse of dominant market position and focused executives, administrative monopoly and pre-inspection systems. It also stipulates the suspension order of antitrust violations, confiscation of illegal gains and the provision of administrative sanctions. but the harsh criminal punishments is not specified in the law. It will be highly introduced next.
In recent years, the Chinese government is strengthening the applications of antitrust laws applied to foreign and domestic companies which are directly related to people’s lives.
Foreign-invested enterprises has become the primary target in this law. Although the Chinese government has announced it would establish a fair and competitive environment of the internal and foreign-funded enterprises in the applications of the antitrust laws. It implies to protect the domestic market in the global competitive atmosphere.
In the practical applications of the antitrust law. It has many ambiguous cases. it currently applies a broader range of illegality than the developed countries do.
