Compensation for Nationalisation of Foreign Property: The Borderland Between Law and Equity

A new constructive means of finding a solution to the issue of compensation by means of a new line of approach provided by the concept of equity. The equity motivated approach, supported by the decision in the North Sea Continental Shelf case, may prove satisfactory in the subject under consideration, that of bridging the gap between the conflicting views and interests of exporting states and of less developed countries.
