Zusammenfassung:The analysis of the representation of the whale in early modern Spanish literature reveals an early concern for the well-being of animals. In this article, I examine the ethical questions that Francisco Antonio de Monteser poses in his mojiganga titled La Ballena (1657-58), in which he inserts the whale into a fictional space giving it an antagonistic role that allows him to denounce its exploitation as well as the legal practice of subjecting animals to criminal trials. El análisis de la representación de la ballena en la literatura áurea revela una preocupación temprana por el bienestar animal. En este artículo examino la pregunta ética que Francisco Antonio de Monteser formula en su mojiganga La Ballena (1657-58) al insertar la ballena en un espacio ficticio otorgándole un protagonismo antagónico que le sirve para denunciar su explotación, así como la práctica legal de someter a los animales a juicios criminales.
