COMPORTAMENTO TÍPICO E IMPUTAÇÃO OBJETIVA PARA ALÉM DO RESULTADO /TYPICAL BEHAVIOR AND OBJECTIVE IMPUTATION BEYOND THE RESULT /COMPORTAMIENTO TÍPICO E IMPUTACIÓN OBJETIVA MÁS ALLÁ DEL RESULTADO

O objetivo geral do presente artigo foi analisar qual a melhor teoria de imputação objetiva no que se refere à extensão dos requisitos em confronto especialmente com o se espera de uma teoria do comportamento típico. O problema, portanto, consistiu em procurar saber se a teoria da imputação objetiva de Claus Roxin oferece suporte teórico suficiente para a resolução dos problemas do direito penal especialmente no que se refere à análise do comportamento típico. A metodologia foi a análise bibliográfica de livros, artigos e legislação à luz da técnica lógico-linguística. O referencial teórico foi Manuel Cancio Meliá. Os resultados alcançados foram de que a teoria de Roxin não é coerente nem uniforme no que se refere à divisão entre a imputação do comportamento e do resultado, confundindo muitas vezes as duas análises, ensejando adequações, como se observa da exposição de Jakobs, Meliá e Frisch. The general objective of the present paper was to analyze what is the best objective imputation theory with regard to the extent of the requirements in comparison especially with what is expected of a typical behavior theory. The problem, therefore, was to find out whether Claus Roxin's theory of objective imputation provides sufficient theoretical support for solving the problems of criminal law, especially with regard to the analysis of typical behavior. The methodology was the bibliographical analysis of books, articles and legislation in the light of the logical-linguistic technique. The theoretical reference was Manuel Cancio Meliá. The results obtained were that Roxin's theory is neither coherent nor uniform as regards the division between the imputation of behavior and result, often confusing the two analyzes, demanding adaptations, as observed by Jakobs, Meliá and Frisch. El objetivo general de este artículo fue analizar cuál es la mejor teoría de imputación objetiva en cuanto a la extensión de los requisitos en comparación, especialmente con lo que se espera de una teoría del comportamiento típico.
