Zusammenfassung: | This paper composes the second part of a research focused on the study and promotion of the social functions of the city and of the property, based on the application of urban planning instruments set forth in Brazilian Law. We affirm that urban planning only confers a social function to the city if there is radical transformation of the private areas, in order to reduce, if not to eliminate, the urban voids, existing by the practice of antisocial use of the right to property. In this second part, we deal specifically with the urban policy instruments called Expropriation and Special Zones of Social Interest (ZEIS, in the acronym in Portuguese) and how they can be applied to promote a right to the city, by definition inclusive, as opposed to the rules of Civil Law, which are traditionally excluding. |
