DECISION BY EQUITY AND DECISION WITH EQUITY: NOTES FOR A DISTINCTION/DECISAO POR EQUIDADE E DECISAO COM EQUIDADE: NOTAS PARA UMA DISTINCAO

This study seeks to analyze the distinction between a decision taken with equity and one taken with equity. Therefore, the two notions are discriminated, identifying their outlines, as well as the occasions and modes of application. In a later moment, the decision with equity is situated in the face of the raciovitalism of Luis Recasens Siches and the three-dimensional theory of Law of Miguel Reale. Para tanto, sao discriminadas as duas nocoes, identificando seus contornos, bem como as ocasioes e os modos de aplicacao. Em um momento posterior, a decisao com equidade e situada em face do raciovitalismo de Luis Recasens Siches e da teoria tridimensional do Direito de Miguel Reale.
