AUTHORIZE OR NEGOTIATE? ANALYSIS OF THE DECISIONS OF THE MUNICIPAL COUNCIL OF URBANISM IN CURITIBA'S URBAN POLICY DURING THE YEAR 2016/AUTORIZAR OU NEGOCIAR? ANALISE DAS DECISOES DO CONSELHO MUNICIPAL DE URBANISMO NA POLITICA URBANA DE CURITIBA DURANTE O ANO DE 2016

This study analyzes the performance of the Municipal Council of Urbanism (CMU), the body responsible for urban land management in Curitiba, specifically regarding its decisions on the application of the building parameters established by the Master Plan and the Law of Land Use and Occupancy of Curitiba issued in 2016. The central objective is to evaluate the compatibility of the mentioned Council with the guideline of democratic management of the city and to identify the trends of its decisions about the urban planning in force. To this end, a bibliographic exploration and legislative analysis of Curitiba's urban planning were used. The methodology is complemented by documentary analysis of the decisions issued by the CMU during 2016. Both examinations indicate the centrality of the Council in local urban policy and the reduced representativeness of civil society in its composition, marked by a technocratic profile. It was also pointed out the influences of the several demands resulting from the city growth and the real estate market in face of the application of the urban legislation in force. Consequently, future reflections should evaluate how to guarantee fidelity to urban planning through CMU's decisions, besides the need to overcome its technocratic profile. Este estudo analisa a atuacao do Conselho Municipal de Urbanismo (CMU), orgao responsavel pela gestao do solo urbano de Curitiba, especificamente no que se refere as suas decisoes acerca da aplicacao dos parametros construtivos estabelecidos por meio do Plano Diretor e pela Lei de Uso e Ocupacao do Solo de Curitiba expedidas no ano de 2016. O objetivo central e avaliar a compatibilidade do referido Conselho com a diretriz da gestao democratica da cidade e identificar as tendencias de suas decisoes acerca do planejamento urbano vigente. Para atingir tal fim, utilizou-se de exploracao bibliografica e analise legislativa do planejamento urbano de Curitiba. Complementa a metodologia a analise documental das decisoes emitidas pelo CMU durante o ano de 2016. Ambos exames indicam a centralidade do Conselho na politica urbana local e a reduzida representatividade da sociedade civil em sua composicao, marcada por um perfil tecnocratico.
