THE TERMINOLOGICAL CONFUSION OF THE CHAPTERS ON FULFILLMENT WITH THE SENTENCE AND ENFORCEMENT PROCEEDINGS OF THE CPC/2015 AND THE SETBACK IN THE EFFICIENCY OF THE PROCEDURAL PHASE OF ENFORCING THE RIGHT/A CONFUSAO TERMINOLOGICA DOS CAPITULOS DE CUMPRIMENTO DA SENTENCA E PROCESSO DE EXECUCAO DO CPC/2015 E O RETROCESSO NA EFICIENCIA DA FASE PROCESSUAL DA EFETIVACAO DO DIREITO

Since Law no. 11.232/05, with the entry into the 1973 Code of Procedure of the sentence fulfillment stage, the doctrine has been divided into treating it, sometimes as part of the process that has been called syncretic, sometimes as part of its own execution proceedings, both under the guise of executive protection or civil enforcement, which would encompass the two forms already mentioned. The study will prove that this doubt remained in the Code of Civil Procedure of 2015, in a frustrating meeting of terms of one form of enforcement in the other, confusing the identity of each of them even after 15 years of the law establishing the dichotomy on Brazilian soil. Desde a lei no. 11.232/05, com o ingresso no Codigo de Processo de 1973 da fase do cumprimento de sentenca, a doutrina ficou dividida em trata-la ora como parte do processo que se denominou de sincretico, ora como parte do proprio processo de execucao, estando ambos sob o manto da tutela executiva ou da execucao civil, que abarcaria as duas formas ja assinaladas. O estudo comprovara que essa duvida permaneceu no Codigo de Processo Civil de 2015, numa frustrante reuniao de termos de uma forma de efetivacao na outra, confundindo a identidade propria de cada uma delas mesmo apos 15 anos da lei que institui a dicotomia em solo brasileiro.
