Zusammenfassung:In front of a Postmodern context, it becomes necessary to return to formal concept of the Democratic State of Right, in order to promote a philosophical reflection on the justifying assumptions of this type of political regime. To remain critically analyzed the arguments of that ideological legal-political sketch, it will be possible to see how the influence of Kant's thought could contribute to the current democratic evaluative promotion.
