THE LIFE IMPRISONMENT, REGULATED BY ROME STATUTE, IN FRONT OF FEDERAL CONSTITUTION 1988/ A PENA DE PRISAO PERPETUA, PREVISTA NO ESTATUTO DE ROMA, EM FACE DA CONSTITUICAO FEDERAL DE 1988

This work aims to study the main aspects of the Rome Statute and the Court (Tribunal) International Criminal, analyzing, from its historical context of implementation to its structure and characteristics, competence and especially its normative status in the Brazilian legal system and the penalties provided for in its content. In this punitive context, we analyze, above all, the appropriateness and application of life imprisonment under the Court. In consequence analysis shall be to seal a life sentence contained in the Federal Constitution of 1988, and as well, its unfolding in our legal system, doctrinal and jurisprudential interpretations of the theme. Thus, weighing the forecast of the Statute and the seal of the Federal Constitution, we will analyze the aspect of this conflict rules aimed resolve one is facing a real or apparent contradiction, and what our position for the solution of this conflict.
