Zusammenfassung: | This article, developed from a lecture entitled "Law and Marxism", pronounced by the author at the XXIII National Meeting CONPEDI, in Florianopolis/SC, on April 1, 2014, aims to analyze some of the contributions to marxist theory today can bequeath to the study of law. Thus, the article makes use of the classic debate by Pachukanis in his famous "General Theory of Law and Marxism", but without intending to transpose the language of Soviet author for this a-historical way. Want, so yes, reread these concepts before the new ways that the Capitalist Mode Production took today--international financialized reproduction of the value form--seeking to understand how the legal system National and International Legal System, has been transformed by this new determinant structural. Debate focuses on the question of the dialectical method as an alternative form of knowledge of the law; highlights the internationalization of law as a new superstructure of regulation of individual behavior and globally market; underscores the importance of classical and Fundamental Human Rights in limiting the power of state and the role they assume in actuality a democratic society; and, finally, discusses the place that the State and the law can take this new setting globalized forces. The method used was deductive analysis and the proposed results constitute a flexible author reinterpretation, without any dogmatic commitment to what could be considered a "correct" interpretation of the fundamental texts of marxism. |
