Zusammenfassung:The article on screen, through a bibliographical research and legal-deductive method, examines, as a problem-theme, the legislation of use and occupation of the Brazilian urban soil and the situation of permissiveness of deforestation, soil waterproofing and consequent reduction of the reflectance of the Solar energy, with effects of concentration in the atmosphere, still, of the GEES, that prevent the solar reflectance to the sidereal space, accumulating heat in the urban greenhouse. Hypothetically, orderly and preferably vertical occupation increases the number of dwellings and reduces the degraded area in favor of environmental equilibrium. It is Justified the research by the elevation of the global temperature due to the low level reflectance of the solar energy, due to the deforestation, waterproofing of the urban soil and the resulting effects. The general objective is to describe the conjunctural dynamics of legal and environmental factors permissive to the paradigm of urban subdivisions and, as specific objectives, the analysis of the legislation affects the framework of art. 225 of the CRFB and the Stockholm Declaration and Law no. 6,938, as well as mitigating and promising measures of vertical construction, in compliance with the factors of the management of solar energy use and urban expansion of green areas.
