Zusammenfassung: | The late twentieth century was marked by several institutional and political factors in Latin American societies. In this context not interventionist materialized by the State, plus the recognition of a plural society base, gave rise to a new constitutional order. The study aims to reflect how the constitutions adopted in this historical period faced both conflicting normative aspects as pointed to new institutional paradigms. In addition, this analytical universe has a long tradition of social thought in Latin American critical and alternative. The study culminates with the indication of an "epistemology of the South" diverging from the Eurocentric perspective. The research aims to answer whether the new constitutional systems are able to meet these critical and autonomous formulations. Apart the solutions, should not be forgotten the analysis of innovative experiences as certain constitutional jurisdictions in Latin America. The research undertaken creates conditions to assess whether the current constitutional period is indeed a rupture or a continuity in the Latin American constitutionalism. |
