Zusammenfassung:The paper aims to discuss the right to housing based on the measures that aim to suspend the compulsory repossession of real estate in Brazil: Bill 827/2020 and Action Against a Violation of a Constitutional Fundamental Right (ADPF) No. 828. It is known that housing has assumed a relevant role in the policies to confront the new coronavirus (SARS-CoV-2) to the point that countries like the United States of America have decreed a moratorium on evictions in the hope of reducing the contagion. To better understand the theme, the article reviews the domestic and international scenario on the right to housing, the discussions in the National Congress and the Federal Supreme Court. This is a qualitative study that, supported by bibliographical research, investigates the existence of a collision between fundamental rights with the possible suspension of measures of compulsory repossession of real estate. The study also analyzes the use of Robert Alexy's maxim of proportionality in the judgment of the injunction in ADPF No. 828 to finally demonstrate that the suspension of forced removals, although it implies a temporary limitation on the right to property, is adequate, necessary and proportional in the strict sense. O trabalho objetiva a discussao sobre o direito a moradia a partir das medidas que visam a suspensao da retomada compulsoria de imoveis no Brasil: o Projeto de Lei No. 827/2020 e a ADPF No. 828/DF. Sabe-se que a moradia assumiu um relevante papel nas politicas de enfrentamento ao novo coronavirus (SARSCoV-2) a ponto de paises, como os Estados Unidos da America, decretarem a moratoria dos despejos na expectativa de diminuicao do contagio. Para melhor compreensao do tema, o artigo recupera o cenario domestico e internacional sobre o direito a moradia, as discussoes no Congresso Nacional e no Supremo Tribunal Federal. Trata-se de estudo qualitativo que, amparado em pesquisa bibliografica, investiga a existencia de colisao entre direitos fundamentais com a eventual suspensao de medidas de retomada compulsoria de imoveis. O estudo analisa, ainda, o uso da maxima da proporcionalidade de Robert Alexy no julgamento da medida cautelar na ADPF No. 828 para, por fim, demonstrar que a suspensao das remocoes forcadas, embora implique em limitacao temporaria ao direito de propriedade, e adequada, necessaria e proporcional em sentido estrito.
