Zusammenfassung: | The article aims to analyze the legalization of controlled access subdivision introduced by Law 13.465/17, evaluating the consequences that this isolation of the population layer causes in the complex urban system, given the socio-environmental functions of the city and property. Through a bibliographic study, it was found that fear and insecurity, due to the prevalence of crime and the omission of the Public Power to promote actions to face the situation, encourages certain social groups, especially those with greater economic power, to gather in closed spaces surrounded by security, leisure and entertainment, taking refuge in a certain way from this social reality found in most Brazilian cities, seeking greater security and quality of life for their family, considering that living in this type of environment, in addition to security, portrays prestige, privacy and exclusivity. What is observed is that the aforementioned "refuge", both due to exclusivity and other factors, can favor the division of classes and ideals in the city, intensifying the culture of individualism and inequality, preventing coexistence between city dwellers, free movement in public spaces, in a way violating the fundamental principles and urban guidelines provided for in the legislation. O artigo objetiva analisar a legalizacao do loteamento de acesso controlado inserido pela Lei 13.465/17, avaliando as consequencias que este isolamento de camada da populacao provoca no complexo sistema urbanistico, ante as funcoes socioambientais da cidade e da propriedade. Por meio de estudo bibliografico, constatou-se que o medo e a inseguranca, devido a prevalencia da criminalidade e da omissao do Poder Publico em promover acoes de enfrentamento da situacao, fomenta para que determinados grupos sociais, especialmente aqueles com maior poder economico, se reunam em espacos fechados cercados de seguranca, lazer e entretenimento, se refugiando de certa forma desta realidade social que se encontra a maioria das cidades brasileiras, buscando maior seguranca e qualidade de vida para a sua familia, considerando que morar neste tipo de ambiente, alem da seguranca, retrata prestigio, privacidade e exclusividade.
