THE DOUBLE OFFENSE IN JUDGMENT OF SINGLE OR LAST INSTANCE AND REFLEX ON RECORRECTABILITY VIA EXCEPTIONAL RESOURCES: BETWEEN JOINT INTERPOSITION AND FUNGIBILITY/A DUPLA OFENSA EM ACORDAO DE UNICA OU ULTIMA INSTANCIA E O REFLEXO NA RECORRIBILIDADE VIA RECURSOS EXCEPCIONAIS: ENTRE INTERPOSICAO CONJUNTA E FUNGIBILIDADE

This article discusses the study of the appropriateness of exceptional resources, the possibility of double offense, the existence of a federal and constitutional issue in the same judgment and the impact on recorrectability. The aim of this study is to investigate whether all the double offenses are equal and, even if they are different, whether they all dialogue with the joint interposition and whether the fungibility of exceptional resources--special and extraordinary--also serve the hypotheses of double offense. The methodology used in the research is deductive, based on bibliographic research on the proposed theme and the objective is the systematization of species of joint interposition, their due relationship with the double offense and the differentiation of these with the fungibility of exceptional resources. Este artigo aborda o estudo do cabimento dos recursos excepcionais, a possibilidade de dupla ofensa, com a existencia de questao federal e constitucional no mesmo acordao e o impacto na recorribilidade. O intuito deste estudo e investigar se todas as duplas ofensas sao iguais e, ainda, caso sejam diferentes, se todas dialogam com a interposicao conjunta e se a fungibilidade dos recursos excepcionais--especial e extraordinario--tambem servem as hipoteses de dupla ofensa. A metodologia utilizada na pesquisa e a dedutiva, com base em pesquisa bibliografica sobre o tema proposto e o objetivo e a sistematizacao das especies de interposicao conjunta, a sua devida relacao com a dupla ofensa e a diferenciacao destas com a fungibilidade dos recursos excepcionais.
