Zusammenfassung: | In this article, we will examine the technique of repetitive appeals and the theory of the instrumentality of the procedure. We will conclude that this mechanism does not fulfill the social scope of the process, as it is unable to generate social peace, resolving conflicts quickly and definitively, promotes radical changes in the dynamics of the Judiciary and in its relations with other powers, impacting the political scope of the process, and brings about profound changes in its legal scope, altering what we understand by adjudication and the role played by judges in the creation and application of law. KEYWORDS: Case law; Repetitive appeals; Instrumentality of the process. Neste artigo, examinaremos a tecnica de julgamento de recursos repetitivos e sua relacao com a teoria da instrumentalidade do processo. Concluiremos que tal mecanismo nao realiza plenamente o escopo social do processo, pois e incapaz de gerar pacificacao social, solucionando os conflitos de modo celere e definitivo, promove radical alteracao na dinamica do Judiciario e nas suas relacoes com os demais poderes, impactando o escopo politico do processo, e traz profundas mudancas em seu escopo juridico, alterando o que entendemos por jurisdicao e o papel exercido pelo juiz na criacao e aplicacao do Direito.
