Zusammenfassung: | Despite being a concept known and used by the legal community today, the social function of tenure in specific cases is revealed to be controversial in the legal literature, in the forum and in the courts. Silvio Perozzi, Raymond Saleilles, Lodovico Barassi e Antonio Hernandez Gil have built theories that explain ownership based on socioeconomic, productivity and social approval elements. It was, therefore, necessary and useful to verify whether the recent jurisprudence of the Superior Court of Justice understands the social function of possession from these possessory theories. This object was chosen because the STJ is the unifying instance of jurisprudence in Brazil. The present research, of a qualitative and quantitative character, analyzed the fundamentals of the social function of possession in the legal literature and in the STJ. To achieve the proposed purpose, the research adopted the systematic review methodology of the jurisprudence, specifically using the statistical analysis of the judges within the scope of the STJ. The data obtained through the research indicate that the ratio decidendi of the judges are pertinent with more than one of the theories. KEYWORDS: Possession. Social function. Productivity. Apesar de ser conceito conhecido e utilizado pela comunidade juridica nos dias atuais, a funcao social da posse em casos concretos se revela como controversa na literatura juridica e no foro. Silvio Perozzi, Raymond Saleilles, Lodovico Barassi e Antonio Hernandez Gil construiram teorias que explicam a posse a partir de elementos socioeconomicos, de produtividade e de aprovacao social. Mostrou-se, assim, necessario e util verificar se a jurisprudencia recente do Superior Tribunal de Justica compreende a funcao social da posse a partir dessas teorias possessorias. O objeto escolhido se deve ao fato de o STJ ser a instancia uniformizadora da jurisprudencia no Brasil. A presente pesquisa, de carater e metodo quali-quantitativo, analisou os fundamentos da funcao social da posse na literatura juridica e nas Turmas do STJ. Para atingir o fim proposto, a pesquisa adotou a metodologia de revisao sistematica da jurisprudencia, especificamente recorrendo a analise estatistica dos julgados no ambito das Turmas do STJ. Os dados obtidos atraves da pesquisa indicam que a ratio decidendi dos julgados guardam pertinencia com mais de uma das teorias. PALAVRAS-CHAVE: Posse. Funcao social. Produtividade. Imovei |
