The Hermeneutics of National Development according to the Democratic State/A Hermeneutica do Desenvolvimento Nacional a Luz do Estado Democratico de Direito

This study propose a new reading of Constitucional Law about the extent of human rights protection from the national and global systems. So there is the intention for analyzing how the connection between geopolitics and law can assure the effectiveness of Constitutional Text and the applicable infraconstitutional legislation. The issue of whether there is sufficient normative latitude in the Constitution to respond to the challenges presented by the post-modern rule of law. Keywords: Geopolitics. O presente estudo propoe uma nova leitura da Constituicao de 1988 sobre a extensao da protecao dos direitos humanos advinda dos sistemas nacional e global. Pretende, pois, analisar como se realiza, a luz do Texto Constitucional de 1988 e da legislacao infraconstitucional aplicavel, a conexao entre o Direito e a Geopolitica. A questao e saber se existe ou nao latitude normativa na Constituicao para responder aos desafios trazidos pelo Estado Pos-moderno de Direito. Palavras-chave: Geopolitica.
