LAND TENURE PROCEDURAL PROTECTION AND FORCED EVICTIONS OF VULNERABLE GROUPS AND LOW INCOME FAMILIES/TUTELA POSSESSORIA E A REMOCAO FORCADA DE GRUPOS VULNERAVEIS E FAMILIAS DE BAIXA RENDA

this study aims to analyze judicial protection applied to collective demands on tenure of urban lands, concerning about assuring applicability of a technical procedure measure which guarantees non violation of human rights of vulnerable groups and low income families in the hypothesis of forced eviction. Thus, we demonstrate the technical inability of the Procedural Civil Law and we suggest guidelines that may contribute to the resolution of these demands according to international covenants of human rights, the right to adequate housing, the social function of property and other rights present at Federal Constitution and Brazilian Urban Law.Key words: Collective Land Tenure Procedural Protection. Social Function of Property.objetiva-se analisar a tutela jurisdicional aplicada as demandas coletivas sobre posse de terras urbanas, preocupando-se em assegurar a aplicabilidade de tecnica processual que garanta a nao violacao de direitos humanos de grupos vulneraveis e familias de baixa renda nas hipoteses de remocoes forcadas. Assim, demonstra-se a inadequacao procedimental do Codigo de Processo Civil vigente e sugerem-se diretrizes que possam contribuir com a resolucao destas demandas a luz dos Pactos Internacionais de Direitos Humanos, do Direito a Moradia Adequada, da Funcao Social de Propriedade e de demais valores presentes na Constituicao Federal e no Estatuto da Cidade.Palavras-chave: Tutela Possessoria Coletiva.
