Zusammenfassung: | We argue, in this essay, that there is no intrinsic relationship between constitutional jurisdiction and democracy, and that the authority of constitutional courts can only be justified by instrumental reasons. Having said that, judicial activism seems something hard to maintain. Nonetheless, this argument only makes sense if the court adopts a non-passivist attitude when it comes to assessing the regularity of the legislative process, in order to secure the full observance of the constitutional rules that define it. Hence, the Brazilian Federal Supreme Court must overrule its decision on MS 22.503 about the proper moment for the submission of amendments to legislative propositions. Argumentaremos, neste ensaio, que nao ha relacao intrinseca entre jurisdicao constitucional e democracia, e que a autoridade das cortes constitucionais so pode ser justificada com razoes instrumentais. Dito isso, o ativismo judicial parece algo dificil de se sustentar. Nao obstante, esse argumento so faz sentido caso a corte adote uma postura nao-passivista em termos de fiscalizacao da regularidade do processo legislativo, com vistas a garantir a plena observancia das regras constitucionais que o definem. Por isso o Supremo Tribunal tem o dever de modificar o seu entendimento externado no MS 22.503 sobre o momento oportuno para apresentacao de emendas aglutinativas no processo legislativo.
