Zusammenfassung:The article aims to answer the question of whether the law should be assumed emancipatory as proposed by critical theories. Our theoretical assumption is that this question deserves a negative response. To answer it, however, and using the method of literature review, we divide the article into three sections. In the first and second section, we map and characterize the critical theories in the general scientific thought and then their problematic projections in legal thinking. In the third section, we respond from jurisprudentialism the questions whether the emancipation is the founding referent of law, not the man-person, and also if it is a legal relevance problem that after all deserve an equally legal response. We concluded in the end that the Law should not replace the validity that it is for social emancipation.Keywords: Law. Critical Theory. Social Emancipation. Jurisprudentialism. Law as a Validity.O artigo tem como objetivo responder a questao de saber se o direito deve assumir-se emancipatorio tal como propoem as teorias criticas. Nosso pressuposto teorico e o de que esta pergunta merece uma resposta negativa. Para responde-la, entretanto, e empregando o metodo da revisao de literatura, dividimos o artigo em tres secoes. Na primeira e na segunda secao, mapeamos e caracterizamos as teorias criticas no ambito do pensamento cientifico em geral e, depois, as suas projecoes problematicas no pensamento juridico. Na terceira secao, respondemos a partir do jurisprudencialismo as questoes de saber se a emancipacao constitui o referente fundante e fundamentante do direito, nao mais o homem-pessoa, e, ainda, se constitui um problema de relevancia juridica que afinal mereceria uma resposta tambem juridica. Concluimos, ao final, que o direito nao deve substituir a validade que o constitui e que ele constitui pela emancipacao social.Palavras-chave: Direito. Teoria Critica. Emancipacao Social.
