Zusammenfassung:The paper is an illustration shown by classical authors about the changing relation between State and Market. The writer has postulated for more than two decades the supremacy of the Market over the State in modern times. Furthermore, Orozco has demonstrated its thesis in many works about the emerging supremacy of the Market since the discovery of America and, overall, the competition of European imperial powers and, more than any other historical process, by the American expansion throughout the world. Questioned by some theoreticians of Law, the author goes toward the beginning of the State to demonstrate how, always ubiquitous, the Market is the main key to understand modern corporate capitalism. Keywords: State, Market, public interest, private interest, fortune, virtue, colonialism, capitalism, imperialism, war, profit.
