"The trilogy is a foreign country, they do things differently there"

This short paper suggests that there is much of value in the Trilogy and also much which is unhelpful. What is of value is the basic approach to section 2(d) set forth by both Justice MacIntyre and Chief Justice Dickson. On the other hand, one of the most unhelpful dimensions of the Trilogy is the approach to international labour law set out by the Chief Justice. Unfortunately we have ended up attached to the latter and having abandoned the former. This paper shows that much flows from these truths for legal cases in both Canadian courts and in the ILO's "supervisory system".
